If in our sole judgment you fail, or Kasaimoto Ltd suspect that you have failed, to comply with any term or provision of these Terms & Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
2. PAYMENT & ORDER
2.1 Cash sales - Payment is due before collection or despatch of the goods. Payment can be made via credit/debit card or electronically via bank transfer.
2.2 International Export - Where the goods are supplied for International export from the United Kingdom, the buyer shall pay the full amount including any agreed shipping costs by Bank transfer directly to the sellers Bank account. The buyer must pay all bank charges for such a transaction not doing so will delay export. On clearance of such funds and receiving of relevant shipping information the goods will be released for export. Email us at [email protected] for purchase& shipping of larger heavier items overseas.
2.3 Price of Goods - The price of the goods shall be the seller’s quoted price or where no price has been quoted (or the quoted price is no longer valid) the price listed in the seller’s current price list at the date of acceptance of the order. All prices quoted are valid for 7days only or until earlier acceptance by the buyer, after which time they may be altered by the seller without giving notice to the buyer. The prices shown are the prices you pay for the product or shipping, they exclude VAT and exclude delivery. If you pay via Paypal, there will be a handling fee that is applied by PayPal. Delivery is outlined in the Delivery terms. Kasaimoto Ltd reserves the right to cancel web orders at any time. Reasons can be due to fraudulent activity, items being out of stock, items being discontinued by the manufacturer or due to miss-pricing on our website.
2.4 To Order - To place an order using the online store, click the Shop button, select your products and click the checkout button. Our payment service will then process your order. Alternatively email us at [email protected] (Open 9am - 5.30pm, Monday to Friday) one of our team members will be able to assist you in any enquiries or orders you may have. We do our very best to satisfy all orders within 24hrs However, please note due to changing workload, we reserve the right to process orders with 48hrs.
2.5 How we will accept your order - Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.
2.6 If we cannot accept your order - If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.
2.7 No order which has been accepted by the seller may be cancelled by the buyer except with the agreement in writing of the seller and on terms that the buyer shall indemnify the seller in full against all loss (including loss of profit), costs (including all cost of all labour and materials used), damages, charges and expenses incurred by the seller as a result of the cancellation.
2.8 The seller reserves the right to make any changes in the specification of the goods which are required to conform with any applicable safety or other statutory requirements.
2.9 Subject to special agreement. The buyer shall pay the price of the goods (less any discount to which the buyer is entitled, but without any other deduction) within 30 days of the date of the sellers invoice, notwithstanding that delivery may not have taken place and the property in the goods has not passed to the buyer. The time for payment of the price shall be the essence of the contract.
2.10 VAT - All sales in the EC will be subject to VAT at the current UK rate. Worldwide sales are VAT exempt
2.11 Security - Our online shop uses a secure server to protect the details you give us when ordering online. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. 3. TITLE OF GOODS
3.1 It is a condition of sale that all goods supplied by Kasaimoto Ltd will remain the absolute property of Kasaimoto Ltd and the title of such goods shall not pass to the purchaser until they have been paid for in full.
3.2 In the event of the purchaser defaulting on payment for any reason, the purchaser will pay all costs, expenses and realisation including legal costs.
3.3 Bankruptcy - The intending purchaser acknowledges that before entering into any agreement or order for the purchase or delivery of any goods from Kasaimoto Ltd, that he/she is deemed to have made current representation on each and every occasion that he/she is not insolvent and has not committed any act of bankruptcy, or being a company with limited or unlimited liability, knows of no circumstances which would entitle any debenture holder to appoint a receiver, present a petition for the winding up of the company, or to exercise any other rights over or against their company assets.
3.4 Loss of Right Possession - The intending purchasers right to possession of the goods pending payment shall cease immediately if he/she, not being a company, he/ she does anything or fails to do anything which would entitle a receiver to take possession of any assets which would entitle any person to present a petition for the liquidation or winding up of the company. Further to this Kasaimoto Ltd is hereby authorised to enter upon any premises where goods are stored or Kasaimoto Ltd may reasonably think that may be stored for any action under this clause.
4. PRODUCT GUARANTEE
4.1 Guarantee will be void if the product returned is dismantled, tampered with or operated outside of its design limits in any way. There are no Guarantee provisions on any goods or products used in or related to Motorsport and associated activities. All products must be returned complete.
4.2 Where the buyer under the Contract (not being a Contract for the International Sale of Goods) deals as a Consumer within Section 12 of the Unfair Contract Terms Act 1977 then nothing contained in any of the following Conditions shall restrict or affect the statutory rights of the buyer.
4.3 Kasaimoto Ltd guarantees that goods shall be free of defect in workmanship and components. If any goods contain such defects, upon written notice thereof by the Buyer, Kasaimoto Ltd shall have the right in its discretion to repair or replace the defective goods or refund a pro-rata of the purchase price applicable to the defective goods. Save as provided herein, all representations, conditions, guaranties and terms, whether express, or implied by common law statute or otherwise, as to the quality, condition or fitness for any purpose of the goods are excluded.
4.4 In no event shall Kasaimoto Ltd be liable under this guarantee for any amounts in excess of the purchase price of the goods and no allowance will be made for labour.
4.5 Kasaimoto Ltd shall not be liable for contingent or consequential damages.
4.6 In the case of Superchargers, this Guarantee covers goods manufactured, remanufactured and serviced by Kasaimoto Ltd for a period of 12 months, after delivery to the user/purchaser. In the case of other components or parts manufactured, remanufactured and serviced by Kasaimoto Ltd, the guarantee period will be given upon request.
4.7 Superchargers used for any form of racing or competition and/or set to run higher than standard Speeds/boost pressure are supplied in good faith and on the understanding that no guarantee is given in respect of performance or reliability of the product, either by the original manufactures or Kasaimoto Ltd.
5. OTHER CONDITIONS
5.1 The Superchargers must be fitted to an engine that is in good working order so that the operation of the Supercharger is not prejudiced.
5.2 The air filter must be changed at the point of Supercharger fitment, using only components and materials approved by the vehicle manufacturers. All associated air ducting and intercoolers should be clean and clear.
5.3 The purchasers/installers shall satisfy themselves that all reasonable steps have been taken to ensure that any original cause of Supercharger failure has been eliminated and that the Supercharger is correct for the application, and is fitted entirely in line with the engine manufacturer’s recommendations.
5.4 Under no circumstances should a vehicle be used if a Supercharger problem is suspected as this could cause further damage to the Supercharger and/or engine.
5.5 Due to the nature of car and engine modification and tuning, Kasaimoto Ltd are not responsible or liable for any damage caused to vehicles/person/property by such modifications, misuse, racing and/or incorrect fitting of products by the customer.
5.6 Components and product manufactured by others which are used by Kasaimoto Ltd in the servicing of Superchargers and offered for resale complete, shall be warranted only to the extent of the warranties of their respective manufacturers. All other warranties, expressed or implied are excluded.
6. Authority to Waive or Alter Terms and Conditions No one other than the directors of Kasaimoto Ltd has the right or authority to waive, alter or vary the Terms and Conditions of business or make any claim or representation or transact any business at variance with them.
7. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
7.1 We do not guarantee, represent or warrant that your use of our services will be uninterrupted, timely, secure or error-free.
7.2 We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
7.3 You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
7.4 You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
7.5 In no case shall Kasaimoto Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, fair wear and tear, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

In return we ask our customers to adhere to our trading terms, which we believe to be fair and reasonable. These terms do not however affect your statutory rights. 9. DISPUTES
All disputes or disagreements which cannot be resolved by negotiation will be settled by UK legislation.
